Dear All,
I am sorry for posting this message on the Immigration group because it doesnt really relate to the immigration issues. I have been a part of this group for a long time, and hence I thought of sharing this with you all. Although we all are here in the US, we all have our families and friends back home in India. This petition (forwarded to me by my friend) is a petition for safety of our people in India. Please do not consider it as a junk post.

Yes, it can be transferred. Fees will include a fee for I-129 ($320) and a fraud prevention fee, which is $500. The employer fee is waived if the non-for-profit company qualifies as non-profit under the U.S. immigration laws.

Hi,
I am a July 2007 filer (EB3 India). In the coming weeks, my employer is opening up senior position in different states and has encouraged existing employees to apply.
If my employer is open to offering me a job for the new position, (and process a EB2 PERM/I-140 for the new position) what would be my option with the existing I-485.
Is it recommended to keep the existing I-485 as is an file a new one? Or should the existing one be updated with the new I-140 (EB2) when that gets approved? How does it affect AC21 portability if existing I-485 is updated.

Hey HybridIllusion,
It all depends on what format your 2d image is in. If it is in AI or EPS, you can automatically import the image into Swift 3D and animate it. If it is a JPG or GIF, you might have a few more steps before importing into Swift 3D.
Take your image and import it into Flash. Export the Flash animation as AI (adobe illustrator) by going to File | Publish Settings | File Types tab. Check the AI box and then publish the movie. The image will be exported in the AI format. From the AI format, you can import into Swift 3D and animate with no limitations.

My local congressman got this reply from USCIS on my AP renewal case. Its been over 90 days and pending? Please help with any advice.

The processing of this case has been delayed. A check of our records establishes that this case is not yet ready for decision, as the required investigation into the applicant background remains open.
Until the background investigation is completed, we cannot move forward on this case. These background checks are required to be completed on all applicants who apply for the immigration benefit they are seeking. We will make every effort to make a decision on this case as soon as the background checks are complete.

I need some clarity on this issue. I know AC21 helps switching jobs within the same field/duties, but here is my line of thought... I'm past 2yrs on my H1 and I plan to do a part-time MBA (~3yrs) after which I'd like to be open on the kind of job I do.
Now, my questions are: (1) Does switching to EAD really pause the H1 clock?
(2) Is that triggered by filling a new I-9 form alone, or by entering the US on AP, or both?
(3) I guess, I should be able to apply for a fresh H1 with a new company and switch back from the EAD to new H1, right?
I know I'll lose the GC priority, especially wife's EAD, but I'm debating if it's worth losing my career aspirations? My info: Nov '06 EB2 PD, approved I-140, July 3 I-485 receipt and my present company will file our EAD/APs as long as it is necessary.

Just spoke to an IO at TSC, She told me that the case is at a place what they call "Pending Review and final decision"
I asked her whats the next step after this?
IO : Hope fully will be assigne to some one
I Asked, isn't this the place where all the cases are "Pending Review and Final decision"?
IO: a big NO...no no..this is not the place where all the cases are, I can't provide anymore info then this, I was just being nice because you called at 3:30 pm.
Any body who has thier case in the pool of "Pending review and final decision".
Honestly, I think its just a general status that she told me about my 485 case.

My H1B expires in September and was filed under a different company name, but they are a successor in interest. so we were planning on amending the H1B when we file to extend. The problem now is - the beneficiary is in a new position AND as of September 1, 2009 the company has changed addresses.
A) In filling out the I-129 in Part 2, questions 2 and 5, what are the appropriate boxes to check?
I am afraid if we amend the current application, it won't also be extended and he will fall out of status.
part 2 Q 2asks " basic for classification" such as
1- new employment
2-continuance of previous approved employment
3-change in previously approved employment
4-new concurrent employment
5-change of employer
6- amended petition
B) Also, what documents, other than what we have, should be included in the filing?
We will file a new LCA with all updated information once we receive a certification of the current LCA and then withdraw it.

Labor approved(eb3 with pd of July 03),
I140 in process,
In my seventh year of H1b on a one year extension expiring in August.
Please advise if I can change employers now and still get a new H1 though I am in my seventh year ?

I efiled for EAD 2 weeks back.Card production ordered last week.approval notice sent this week.

It can be done in Swift 3D. First, create a box. Then create a pyramid shape and place it above the box. Color the pyramid red and the box a white or brown. You now have a house.
