Hi ,
I Am planning to apply for my 10th Year H-1B Extension with the same employer.
My last H-1B was in 2007. I looked on doleta.gov The Prevailing Wage
in 2007 for the same job and same location as I am right now at
Level 3 was 57000.00, Now in 2010 it is 76000.
I talked to my Employer about this, he says he cannot raise my salary that much.
My Question is
1. When I applied for Foreign Labor Cert On-line does the
Prevailing Wage has to be most recent even in case of H-1B Extension ?
2. Is is ok If I go to Level-2 Instead of Level-3, will it considered as
change in Employment ?
3. The Prevailing Wage for 2008 for the same job and same location
as I am right now at is 66000. Should I Try to Apply for labor
cert referencing 2008 Prevailing Wage. ?
4. What are my options ?

According to the mathew ohio website. there is apparently a very hot legal battle going on between the DHS and a happless immigrant who had been arested for out of status presence. The immigrant was on an H1b and had filed an application in a timely manner and was awaiting decision on his application when the DHS official arrested him and tried to deport him. Please post more information on this issue if anybody is aware of it. His I-94 expired, however, his petition for H1b extension was pending!!!!:o:o:o

Was on H4. Have an EAD now. Want to renew.
While renewing, on the form, there are 2 questions:
14 Current Immigration Status
15 Manner of Last Entry
(both seem to have the same answer)
Any idea .. what I need to fill here?

My friend John Lamb in Nashville blogs today about ICE's Hutto detention center where whole families are jailed while awaiting deportation. I'm reminded of Charles Dickens' tales of debtors prisons in Victorian England where "lawbreakers" who violated British laws relating to debt were jailed right along with their spouses and children. A report from the Leadership Conference on Civil Rights Education Fund shows that hate crimes targeting Hispanics rose 40% from 2003 to 2007. The report can be found here. If H4 uses EAD for work with 485 pending, and if the underlying I-140 gets rejected, will this make H4 holder be out of status? what are the options for H4 holder.
If I 140 is rejected then the EAD,AP and I 485 are rejected as well. If you have used EAD then ur H4 is no longer valid ! You will have to go out of the country and get H4 stamped.
So the recommendation is to keep H status alive till you get Greencard

Hello everyone, thanks in advance for any reply.
I mailed in my wife's I485 and I130 together (she's from China, and we just got married a month ago), and I just realized that I forgot to include the marriage license with the forms!
Now, what are my options? I noticed that they have not cashed my 2 checks yet, should I cancel them so I at least don't get charged for the forms that will be rejected?
Or, is there any way for me to mail the marriage license separately and hope they get it?
Right now, I think it would be better to just redo the forms, but do I have to wait for the forms to get rejected first?

Folks,
I filed concurrently I 140 and I 485.
My application has been transferred from California to Nebraska.
I wanted to check if folks have seen any updates on thier cases.
I noticed on the website, for my I 140 status it does not show any date etc, it simply says case transferred to a USCIS office. For some folks it shows on a specific date..XX XXXX we recd your case at this office..
Can we all share our data under this thread for I 140 filing with 485 on July 2.

1. Applied my first EAD thru some lawyer (hence G-28)
2. I am planning to renew it on "my own"
Can I renew EAD without Attroney help... I know the answer "YES" but the main question is... do I need to inform USCIS saying that I want to withdraw my lawyer's and hence G-28 which was filed along with my first EAD?

On March 19, 2010, the USCIS announced revised filing instructions and addresses for applicants filing an I-131, the Application for Travel Document.
Beginning March 19, 2010 applicants will have to file their applications at the USCIS Vermont Service Center or at one of the USCIS Lockbox facilities.
If you file the I-131 at the wrong location, the USCIS Service Centers will forward it to the USCIS Lockbox facilities for 30 days, until Monday, April 19, 2010. After April 19, 2010, incorrectly filed applications will be returned to the applicant, with a note to send the application to the correct location.

The case speaks to several issues -- how the Bush administration deals with critics of the war in Iraq, and the games that Washington's reporters and politicians play with each other. As far as the jury is concerned, however, the case is about only one thing: lying.
One particularly well-qualified witness on this subject was not called by either the prosecution or the defense, so today we cross-examine Robert Feldman ourselves. Feldman is a social psychologist at the University of Massachusetts who studies lying in everyday life, and his findings are just the kind of thing that Libby's lawyers could have pounced on.
Feldman's experiments show that stern-faced judicial proceedings about perjury are as remote from the realities of human behavior as President Bush is from the Nobel Peace Prize. For one thing, lying plays a more complex role in human relationships than the black-and-white legal view recognizes. It is also so commonplace in everyday life that putting people on trial for lying is somewhat like putting them on trial for breathing.
Experiments have found that ordinary people tell about two lies every 10 minutes, with some people getting in as many as a dozen falsehoods in that period. More interestingly -- and Libby might see this as the silver lining if he is found guilty -- Feldman also found that liars tend to be more popular than honest people. (Ever notice how popular politicians somehow change their minds on controversial issues such as the war in Iraq at the exact moment that public opinion on those issues changes?)

I am planning to apply for Alberta Nomination Program under NOC (Manufacturing and Industrial Engineers). Does anybody has any experience with this NOC. Also, I need to know how does this process work. I apply for ANP and when I need to move I apply for jobs and then I get work permit...right ? Then if I need to get a TN visa to come back to usa how do I do that. I have a house in chicago, so wondering if renting that out could be an option for me when I immigrate to alberta so that when I need I can come to chicago. I am in my 5th year of H1B and with the current scenario my present company is not going to start my GC (it stopped because of layoffs in the company).
